These Terms apply to your use of the Ledger Quest Services and our Platform. We encourage you to read them carefully. Please also refer to the definitions set out at the bottom of this page. The Terms and any attachments related to it, including our Privacy Policy, and, applicable guidelines, forms a legal Agreement between you and Ledger for your use of the Ledger Quest Services.

These Terms define the terms and conditions under which you are allowed to use the Ledger Quest Services and Resources. If you do not agree to these Terms, you must immediately discontinue your use of the Ledger Quest Services and Resources.

If you’re under the age of 18, you must have your parent or legal guardian’s permission to use the Ledger Quest Services. Please have your parent or legal guardian read these terms with you. If you’re a parent or legal guardian, and you allow your child to use the Ledger Quest Services, then these terms apply to you and you’re responsible for your child’s activity on the Ledger Quest Services.

Ledger believes that education is the key to the future of a decentralized ecosystem in which people can self-custody their assets safely and become digitally sovereign. In order to do so we developed a Platform where you can complete different Quests in order to learn, play & earn around all things web3!

A Quest is essentially a quiz or a series of quizzes that is limited in time and can be code or token gated depending on the overarching concept. Once you complete a Quest you are rewarded with an exclusive POK NFT. Be aware that to complete the Quests and enjoy the Ledger Quest Services you will have to connect your web3 wallet.

You may not be eligible to all the Quests: some are token gated, meaning that to complete them, you’ll need a specific community token, or a proof-of-knowledge token to show an existing level of knowledge. This allows exclusive quizzes to be offered for specific communities and experience levels.

You agree to only use the Ledger Quest Services and Resources for the purposes intended and as permitted by the Agreement and in accordance with applicable laws. If you use the Ledger Quest Services in breach of the Agreement or applicable laws we may suspend your use of the Ledger Quest Services.

You must promptly notify our Customer Support Team about any possible misuse and incident related to the Ledger Quest Services.

The Ledger Quest Services and Resources are the property of Ledger and Ledger third party partners. We grant you a limited, non-exclusive, revocable license to make use of the Ledger Quest Services and the Resources in accordance with the Agreement. You agree to abide, at any time, by any guidelines which are applicable to your use of the Ledger Quest Services and the Resources.

Except for the rights expressly granted to you in the Agreement, Ledger grants no right, title, or interest to you in the Ledger Quest Services and Resources. The Ledger Brands are the sole property of Ledger or its third party partners. The Agreement does not grant you any right to use any Ledger Brand for any purpose, whether for commercial or non-commercial use. You are not allowed to use the Ledger Quest Services for advertising, marketing or sales activities unless expressly authorized by Ledger in an agreement.

Any commercial exploitation of the POK NFTs without express prior written permission from us or the applicable rights holder is strictly prohibited. POK NFTs created by third party partners may have specific additional terms and conditions, said additional terms and conditions are defined by our third party partners.

In the case you are provided with links to external resources while browsing the Ledger Quest Services and Resources, use them carefully as they are outside of our control. You acknowledge Ledger cannot be held responsible for any failures or the damages caused by a third party resource.

You acknowledge that Ledger will not be held responsible for the failure of any hardware you use to access the Ledger Quest Services and Resources.

Ledger will use a reasonable level of skill and care to ensure that the Ledger Quest Services can be accessed by you in accordance with this Agreement, but there are no guarantees that access and features will not be interrupted or that there will be no delays, failures, errors, omissions, corruption or loss of transmitted information. The Ledger Quest Services are provided “as is” without any warranty of any kind, either express or implied, and in particular without implied warranties of merchantability, reliability, and fitness for a particular purpose.

You accept and agree that blockchain based elements of the Ledger Quest Services such as POK NFTs will require you to connect your wallet. It is solely your responsibility to secure your access to your devices, your wallet, the Quests and Ledger Quest Services or its elements. It is your responsibility to protect your passwords, private keys and recovery phrase as Ledger is not responsible for these elements.

You are solely responsible for safeguarding your NFT POKs and all associated risks, and Ledger has no duty to you or any user except as otherwise provided under this Agreement. Ledger does not permit the infringement of intellectual property rights on the Ledger Quest Services, and will remove Resources from the Ledger Quest Services if properly notified that such Resources infringe on another’s intellectual property rights. We reserve the right to remove Resources from the Ledger Quest Services, in whole or in part, without prior notice, for any reason and in our sole discretion.

To the maximum extent permitted by law, in no event will Ledger, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for (1) any indirect, special, incidental, punitive, exemplary, or consequential damages; or (2) any loss of use, data, business, or profits (whether direct or indirect), in all cases arising out of the use or inability to use Ledger’s services, Third Party Applications, Ledger Quest Services and Content, regardless of legal theory, without regard to whether Ledger has been made aware of the possibility of those damages, and even if a remedy fails of its essential purpose.

Nothing in the Agreement removes or limits Ledger’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence, and, if required by applicable law, gross negligence.

In the course of its activities, Ledger may have to process and collect personal data.

As a data controller, Ledger processes personal data under the terms set out in the French Law no. 78-17 of 6 January 1978, known as "Informatique et Libertés", amended and the General Data Protection Regulation (the Regulation (EU) 2016/679).

The Agreement will continue to apply as long as you use the Ledger Quest Services. Ledger may terminate the Agreement or suspend your access to the Ledger Quest Services at any time, including in the event of your actual or suspected unauthorized use of the Ledger Quest Services and/or Resources, or noncompliance with the Agreement.

If you or Ledger suspends your access to the Ledger Quest Services, you agree that Ledger shall have no liability or responsibility to you. Any License granted to you on the Ledger Quest Services shall be terminated as of the termination of the Agreement.

Sections of the Agreement, that, either expressly or by nature, must remain in effect even after termination of the Agreement, shall survive termination.

Except where otherwise provided, the Agreement constitutes all the terms and conditions agreed upon between you and Ledger and supersedes any prior agreements in relation to the subject matter of this Agreement.

In the event of any conflict between these Terms and any other document referred to herein, these Terms shall prevail.

In the event that any provision of these Terms is declared void or inapplicable, it shall be deemed to be replaced by a valid provision reflecting as closely as possible the objective pursued by the original provision. The other provisions shall not be affected and shall remain in full force and effect.

The fact that Ledger does not exercise its rights arising from these Terms does not in any case constitute a waiver or loss of these rights.

Ledger may assign the Agreement or any part of them, and Ledger may delegate any of its obligations under the Agreement. You may not assign the Agreement or any part of them, nor transfer or sublicense your rights under the Agreement, to any third party.

We reserve the right to change these Terms from time to time.

These Terms are governed by French law. French law provides a high level of consumer protection. However, you also benefit from the protection provided by the mandatory laws of your country of habitual residence when these laws are more favorable to you and would have been applicable in the absence of a choice of French law.

In the event of a complaint or a question relating to the Ledger Quest Services, please contact Ledger via the live chat available at the bottom right of your screen here making sure to specify to provide any information to Ledger to allow it to assess the origin and implications of your complaint or question.

ANY DISPUTE RELATING TO THE APPLICATION OR INTERPRETATION OF THESE TERMS WHICH CAN NOT BE SOLVED AMICABLY WILL BE BROUGHT BEFORE THE COURT WITH MATERIAL AND TERRITORIAL JURISDICTION UNDER THE APPLICABLE LAWS, IN ACCORDANCE WITH THE LEGAL AND REGULATORY PROVISIONS IN FORCE.

"Agreement" is the collective term that encompasses these Terms and the Privacy Policy.

"Ledger" means Ledger SAS, Ledger Technologies Inc., and all other entities that are part of the Ledger group of companies.

"Ledger Brands" means all Ledger trademarks, service marks, trade names, logos, domain names, and any other feature of the Ledger brand.

"Ledger Quest" means a Quest tailored to the needs of Web3 communities and brands, providing a high-quality experience, essential Web3 knowledger and POK NFTs rewards for community members and Ledger Quest Services users.

"Ledger Quest Services" means the services available through the Ledger Quest Platform that you use under these Terms.

"Licence" means the license granted to you pursuant to Section 4 of these Terms.

"Platform" means the Ledger Quest Platform.

"POK NFT(s)" means proof of knowledge, non-fungible tokens. These are tokens that serve as a proof of knowledge and rewards for a quest completion and can take different forms (e.g. artwork, collectible, metaverse wearable, etc.).

"Quest(s)" means a quiz, consisting of one or multiple chapters, rewarding the users who complete it with NFTs. Quests can have a time cap or a supply cap (e.g. number of NFTs minted). Quests can be token/code gated or open to anyone.

"Resources" means the information, resource, services, products, POKs, and tools provided for you in the Ledger Quest Services.

"Terms" means these general terms and conditions applicable to your use of the Ledger Quest Services.

"Third Party Applications, Services, and Content" means website, services, and, content delivered by third parties that are integrated into the Ledger Quest Services and Resources in order to make certain features, content, products, and/or services available to you.

"Website(s)" means the Ledger websites including ledger.com.
